These Terms of Service (“Terms”) form a binding agreement between you and VeloChess (“VeloChess”, “we”, “us”, or “our”) governing your access to and use of our website, applications, and related services (collectively, the “Service”). Please read them carefully.

By accessing or using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, you must not use the Service.

1. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use the Service. If you are under the age of majority where you live, you may use the Service only with the involvement and consent of a parent or legal guardian who agrees to be bound by these Terms. By using the Service, you represent and warrant that you meet these requirements and that you have the legal capacity to enter into this agreement.

2. The Service

VeloChess provides tools to play chess online against AI opponents and other people, along with AI-assisted coaching, analysis, rating estimates, puzzles, and game review. The Service is currently provided free of charge, and we may add, modify, suspend, or discontinue any feature at any time without notice or liability.

The Service does not require an account. Access is associated with a randomly generated guest identifier stored on your device. You are responsible for activity that occurs through your device and browser.

3. Acceptable Use

You agree that you will not, and will not attempt to:

  • Use the Service for any unlawful purpose or in violation of any applicable law or regulation;
  • Harass, abuse, threaten, defame, or harm other users, or send offensive, obscene, hateful, or otherwise objectionable content, including through chat;
  • Interfere with, disrupt, overburden, or attempt to gain unauthorized access to the Service, our servers, or any systems or networks connected to the Service;
  • Circumvent, disable, or interfere with security-related features, rate limits, or access controls;
  • Use bots, scrapers, crawlers, or other automated means to access the Service, or copy, harvest, or extract data, except as expressly permitted by us in writing;
  • Reverse engineer, decompile, or disassemble any part of the Service, except to the extent such restriction is prohibited by applicable law;
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity;
  • Introduce viruses, malware, or other harmful code, or engage in any activity that could damage, disable, or impair the Service.

We reserve the right, but are not obligated, to monitor use of the Service and to remove content or restrict, suspend, or terminate access for anyone who violates these Terms or whose conduct we deem harmful, in our sole discretion.

4. User Content

“User Content” means any content you submit through the Service, such as display names and chat messages. You retain any rights you have in your User Content. By submitting User Content, you grant VeloChess a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, display, and use that content solely as necessary to operate, provide, and improve the Service.

You are solely responsible for your User Content and represent that you have all necessary rights to submit it and that it does not violate these Terms or any third-party rights. We may remove any User Content at any time for any reason.

5. Intellectual Property

The Service, including its software, design, text, graphics, logos, and all related intellectual property (excluding your User Content), is owned by VeloChess or its licensors and is protected by intellectual property and other laws. Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Service for your own personal, non-commercial use. All rights not expressly granted are reserved. You may not use our name, logos, or branding without our prior written permission.

6. AI-Generated Content & Chess Analysis

Coaching, evaluations, rating estimates, commentary, puzzles, and other outputs generated by the Service, including those produced using artificial intelligence, are provided for entertainment and educational purposes only. They are automated estimates, may be inaccurate, incomplete, or inconsistent, and do not constitute professional advice. You should not rely on them as definitive, and you use them at your own discretion and risk.

7. Third-Party Services

The Service relies on and may link to third-party services and content that we do not own or control. Your use of such third-party services may be subject to their own terms and policies. We are not responsible or liable for any third-party services, and their inclusion does not imply endorsement.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE MAXIMUM EXTENT PERMITTED BY LAW, VeloChess DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY CONTENT OR RESULTS (INCLUDING RATINGS OR ANALYSIS) WILL BE ACCURATE OR RELIABLE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL VELOCHESS OR ITS OWNERS, OPERATORS, EMPLOYEES, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OR EXCLUSIONS OF LIABILITY, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

10. Indemnification

You agree to indemnify, defend, and hold harmless VeloChess and its owners, operators, employees, and suppliers from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your use of the Service, your User Content, or your violation of these Terms or any applicable law or third-party rights.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including if we believe you have violated these Terms. Upon termination, the provisions of these Terms that by their nature should survive—including intellectual property, disclaimers, limitation of liability, indemnification, and governing law—will continue to apply. You may stop using the Service at any time.

12. Changes to the Service and Terms

We may modify these Terms from time to time. When we do, we will update the “Last updated” date above and post the revised Terms on this page. Changes are effective when posted. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the changes, you must stop using the Service.

13. Governing Law & Dispute Resolution

These Terms and any dispute arising out of or relating to them or the Service are governed by the laws applicable at our principal place of business, without regard to conflict-of-law principles, and to the extent permitted by mandatory laws of your country of residence.

Before filing any formal claim, you agree to first contact us at support@valeworth.com and attempt in good faith to resolve the dispute informally. If a dispute cannot be resolved informally, you agree that it will be resolved on an individual basis, and, to the extent permitted by applicable law, you waive any right to participate in a class, collective, or representative action.

14. General

These Terms, together with our Privacy Policy, constitute the entire agreement between you and VeloChess regarding the Service and supersede any prior agreements. If any provision is found unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision is not a waiver of that right or provision. You may not assign or transfer these Terms without our prior written consent; we may assign them freely.
